Use of this site is provided by Suviksha Venture India Pvt. Ltd. (henceforth referred to as Suviksha) subject to the following of the Terms and conditions as given below.

Your use and access to the website constitute acceptance of these Terms and Conditions as at the date of your first use of the website.

You agree to use the website only for lawful purposes, and in a manner which does not infringe the rights, or restrict, or inhibit the use and enjoyment of the website by any third party.

Suviksha reserves the rights to change these Terms and Conditions at any time by posting changes online. Your continued use of the website after changes are posted constitutes your acceptance of the new Terms and Conditions as modified automatically. You should, therefore, review these Terms and Conditions regularly.

Suviksha takes no responsibility for the content of external internet websites. Following links to any other websites or pages shall be at your own risk and Suviksha shall not be responsible or liable, directly or indirectly, for any damages resulting from the use of such other websites.

All intellectual property on the website and the material or information it contains including without limitation copyright, designs, database rights and trademarks (registered or unregistered) are and shall remain the property of Suviksha or its third party licensors.

Commercial use or publication of all or any item displayed on the site without authorization from Suviksha is strictly prohibited. Nothing contained in these Terms and Conditions shall be construed as conferring any licensee by Suviksha to use any item displayed.

Materials in the website may be copied for personal use only on the condition that all copyright notices and source indications are also reproduced, no modifications are made and each relevant item is copied in its entirety. Some materials that have been outsourced have been published on the website with all the necessary permissions from the relevant copyright owners (who are not part of Suviksha). All rights are reserved on these materials and permission to copy them must be requested. from the individual copyright owners (as indicated within these materials).

Any communication or material that you transmit to, or post on, any public area of the website including any data, questions, comments, suggestions, or the like, is and will be treated as non-confidential and non-proprietary information. Suviksha reserves the right to remove any such communication or material from the website at its own discretion.

If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on the Website relating to specific material then the latter shall prevail.

These Terms and Conditions shall be governed and construed in accordance with the laws of India. Any disputes shall be subject to the non-exclusive jurisdiction of the Indian Courts.

If these Terms and Conditions are not accepted in full, the use of the website must be terminated immediately.

Visitors acknowledge that visiting this site is an implicit acceptance of these 'Terms and Conditions' on their part.

Accepting 'Terms and Conditions' means an implicit acceptance of our Disclaimer and Privacy Policy

We do not provide any financial return in any form whatsoever, including but not limited to financial securities (debt or equity), interest, dividend, profit share, rewards in cash, to individuals who contribute on suviksha.com

Any contribution on suiksha.com, by an individual, should not be construed as an investment in any form whatsoever.

Suviksha.com, a platform for giving and philanthropic donations, owned by Suviksha Ventures India Pvt. Ltd, incorporated under the Companies Act, 1956 with its registered office at Near Shanti Cinema Hall, Basant Vihar Colony, Ramgarh, Jharkhand - 829122.

Suviksha.com ("Suviksha," "we," "us," "our") provides its services (described below) to you through its website located at www.suviksha.com (the "Site") and related services (collectively, such services, including any new features and applications, and the Site, the "Services"), subject to the following Terms of Service (as amended from time to time, the "Terms of Service"). We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We will also notify you, either through the Services user interface, in an email notification or through other reasonable means, and unless otherwise stated, Suviksha may communicate with you officially by any reasonable means now known or later developed. These currently include email, regular mail, and postings on the Site. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms of Service.

The Services are a Platform; We are not a Broker, Financial Institution, Creditor or Charitable Institution: The Services are an administrative platform only. Suviksha facilitates the Donation transaction between Champions and Donors, but is not a party to any agreement between a Champion and a Donor, or between any user and a Charity. Suviksha is not a broker, agent, financial institution, creditor or insurer for any user. Suviksha has no control over the conduct of, or any information provided by a Champion or a Charity, and Suviksha hereby disclaims all liability in this regard. Anyone is free to report issues related to a Campaign on Suviksha, and Suviksha will take necessary action to the best of its abilities.

Suviksha does not guarantee that a Campaign or a Charity will obtain a certain amount of Donations or any Donations at all. We do not personally endorse any Campaign, Champion, or Charity, and we make no guarantee, explicit or implied, that any information provided through the Services by a user is accurate. We expressly disclaim any liability or responsibility for the success of any Campaign, or the outcome of any fundraising purpose. You, as a Donor, must make the final determination as to the value and appropriateness of contributing to any Campaign, Champion, or Charity. You can write to us for any clarification, and we shall make our best effort to share the information that we have.

While we try our best to do so, we cannot and do not verify 100% of the information that Champions supply. We try our best to see that Donations are used in accordance with the stated fundraising purpose; we also collect documents related to Campaigns before disbursing Donations to the Champion for Campaigns that raise more than INR 50,000, or in other cases that Suviksha may determine, at its sole discretion. However, please understand that we can not guarantee that 100% of the time Donations will be used in accordance with any fundraising purpose prescribed by a Champion or Charity. . We assume no responsibility to verify whether the Donations are used in accordance with any applicable laws, and such responsibility rests solely with the Champion or Charity, as applicable. While we have no legal obligation to verify that the use of any funds raised is in accordance with applicable law and these Terms of Service, we try to do the verifications for many campaigns and more important we take possible fraudulent activity and the misuse of funds raised very seriously. If you have reason to believe that a Champion or Charity is not raising or using the funds for their stated purpose, please use the "Report" button on the Campaign to alert our team of this potential issue and we will investigate to the best of our abilities.

We encourage you, particularly if you intend to donate to a Suviksha campaign or raise funds for a need, to review the Frequently Asked Questions section of the website to understand the steps taken by Suviksha to foster greater trust and transparency.

You, as a Champion, represent, warrant, and covenant that (i) all information you provide in connection with a Campaign is accurate, complete, and not otherwise designed to mislead, defraud or deceive any user; and (ii) all Donations contributed to your Campaign will be used solely as described in the materials that you post; and (iii) you will comply with all relevant local, state, and Union laws applicable to you when you solicit funds, particularly but not limited to laws relating to your marketing and solicitation for your project. We reserve the right to provide information relating to your Campaign with donors and beneficiaries of your Campaign, and with law enforcement or to assist in any investigation.

 

The terms and conditions that apply to a Campaign Organiser (Champion) are:

You are solely responsible for utilizing the funds for the Purpose mentioned in our fund-raising page. Suviksha is not responsible in any way whatsoever towards the end utilization of funds.

This fund-raising page on the Platform will be available to the general public for contributions from the time you published the page on the Platform, and if your campaign is not rejected by Suviksha. You may or may not be able to raise the targeted amount in the designated period. Suviksha can reject your fundraiser for inappropriate or insufficient content, at its sole discretion.

Suviksha will not be responsible in any way whatsoever on the amount of contributions received. It will be your sole responsibility to address any query on objection, from a donor, in regards to utilisation of funds.

Campaigns on the Suviksha platform shall automatically terminate within 24 -48 hours of the goal amount of the Campaign being reached.

You shall not use any content created by Suviksha, partially or wholly, for any other fundraising or awareness purpose without the written consent of Suviksha. In the event you receive such consent, you shall provide written credits to Suviksha and provide links to Suviksha.org or corresponding social media handles of Suviksha, while using such content, and adhere with such other terms that may be prescribed by Suviksha from time to time.

Provided that all statutory verifications and KYC verifications are completed and you have provided Suviksha with documents that substantiate the utilization of funds you may receive, all contributions collected for your Campaign will be transferred to the designated bank account that you specify. You can raise withdrawal requests post approval of the campaign by Suviksha. Suviksha will process fund transfer, post receipt of your withdrawal request.

You understand that the funds are not owned by Suviksha or its affiliates. At the time of transfer of funds, you will receive contributions net of Suviksha Fees, Payment Gateway Fees, applicable taxes, or any other fees mutually agreed upon between you and Suviksha. In case of contributions outside India, You have the necessary regulatory permissions to receive such funds, Such permissions include but are not limited to the Foreign Contributions Registration Act (FCRA), and others mandated my regulatory authorities.

Please note that in accordance with the FCRA, the following persons cannot receive foreign contributions. This list may be amended from time to time in accordance with regulatory and statutory actions, and such amendment shall apply to you with immediate effect from such regulatory or statutory action.
